- Content: any text, images, videos, downloads, PDFs, programs, emails, and materials we provide.
- Coaching: non-medical wellness coaching focused on behavior change, education, and support.
- Digital Resources: downloadable or accessible resources (PDFs, trackers, guides, recordings, templates).
3. Educational & Coaching Disclaimer
Live Happily Healthy LLC provides wellness coaching and educational information only. Nothing on this Site or in Services is medical, mental health, legal, or financial advice. Content is not intended to diagnose, treat, cure, or prevent any condition.

4. Eligibility
You must be at least 18 years old to use this Site or Services. By using the Site, you represent that you are of legal age and capable of entering into a binding agreement.
5. Coaching Services
By booking or participating in Coaching, you acknowledge and agree:
- You are voluntarily participating in wellness coaching.
- Swati Thakur is a certified health and wellness coach and is not acting as a licensed medical provider.
- You are responsible for your own decisions, actions, health choices, and outcomes.
- Coaching is not psychotherapy and is not a substitute for professional medical or mental health care.
6. No Guarantees
We do not guarantee any particular outcome, result, or level of progress. Results vary based on many factors, including your personal history, consistency, and circumstances.
7. Intellectual Property
All Content on this Site—including text, videos, graphics, PDFs, programs, downloads, and materials—is owned by Live Happily Healthy LLC / Swati Thakur unless otherwise stated. You may not copy, reproduce, republish, distribute, sell, sublicense, or exploit any Content for commercial purposes without written permission. You may share brief excerpts with proper attribution and a link back to the original page, provided you do not misrepresent the Content or remove notices.
8. User Conduct
By using this Site, you agree not to:
- Violate any applicable law or regulation.
- Harass, threaten, spam, impersonate, or harm others.

9. Payments, Refunds & Cancellations
Global rules (apply to all services)
- Payment in advance: All services must be paid in full to confirm booking/enrollment unless otherwise stated.
- Services rendered: Fees for sessions already delivered are non-refundable.
- Processing fees: Third-party processing fees (Stripe/PayPal), currency-conversion fees, chargeback fees, and platform commissions are non-refundable. If a refund is approved, these may be deducted from the refund unless the processor returns them to us.
- Refund method: Approved refunds are issued only to the original payment method. Banks may take 5–10 business days to post credits.
- Contact first: Email contact@livehappilyhealthy.com so we can resolve it quickly.
A. 1:1 Single Sessions
- Reschedule/Cancel: Allowed with ≥24 hours notice for a full refund or free reschedule.
- Late cancel / No-show (<24h): Charged in full; no refund.
- Late arrival: Sessions end at the scheduled time; unused time is forfeited.
B. Packages & Subscriptions (monthly programs)
- Automatic billing: Recurs on your billing date unless canceled.
- Cancel anytime: Cancellation stops future renewals only. The current billing period is non-refundable.
- Missed sessions: Not refundable. We will attempt to reschedule within the same billing period when possible.
C. Pay-in-Full Programs
- Grace window: Refunds within 7 calendar days of purchase, minus the value of any sessions used (at the current single-session rate) and any non-refunded processor fees.
- After 7 days: Non-refundable.
- Optional pause (only if offered): One pause up to 30 days with written notice (if applicable).
D. Group Programs / Workshops
- Cancellation/Reschedule: ≥48 hours before the start for a full refund; <48 hours is non-refundable due to group coordination and materials.
- Missed group sessions: Not refundable and may not be rescheduled individually.
E. Digital Resources
- All sales final once delivered, accessed, or downloaded due to the nature of digital products.
F. BNPL & Alternate Payment Methods
- Installment options may be offered by third-party providers at checkout. If a refund is approved, remaining installments are handled per the provider’s policies and may be reduced by non-refundable processing fees.
G. Disputes / Chargebacks
- Please contact us first to resolve any issue. Filing a chargeback pauses further services until resolved.
- If a chargeback is filed without first contacting us, you may be responsible for associated fees where permitted by law.
10. Third-Party Links & Tools
We may link to third-party websites, tools, or services (e.g., scheduling platforms, payment processors, analytics tools). We are not responsible for their content, policies, or practices. Your use of third-party services is at your discretion and subject to their terms.

12. Disclaimer of Warranties
The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
To the fullest extent permitted by law, Live Happily Healthy LLC and Swati Thakur will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Site or Services, including reliance on Content. Your use is at your own risk.
14. Indemnification
You agree to indemnify and hold harmless Live Happily Healthy LLC and Swati Thakur from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights of another person or entity.

We may suspend or terminate your access to the Site or Services at any time if we believe you have violated these Terms or engaged in unlawful or harmful behavior.

17. Dispute Resolution
If a dispute arises, the parties agree to try to resolve it informally first by emailing
contact@livehappilyhealthy.com.
If the dispute cannot be resolved, it will be handled in the state or federal courts located in Indiana. Both parties consent to personal jurisdiction and venue in Indiana.
18. Governing Law
These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law principles.
19. Electronic Communications
By using the Site or Services, you consent to receive communications from us electronically (e.g., email, notices on the Site). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
20. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and us regarding the Site and Services and supersede prior communications.
